10. Governing Law. These Terms of Use will be construed, enforced and governed in accordance with the laws of the State of Illinois, without regard to any conflict of law principles that would apply the laws of another state. The state or federal courts in Cook County, Illinois will have exclusive jurisdiction and venue over all controversies in connection with these Terms of Use, and you hereby consent to such exclusive and personal jurisdiction and venue. Any claim you may have against CashLendingNow must be brought within one (1) year after the cause of action arises, or such claim or cause of action is barred. You agree to waive any right to a jury trial in connection with any action or litigation in any way arising out of or related to these Terms of Use and that each party has the right to seek attorneys’ fees in any proceeding. The parties hereby agree to submit any dispute arising out of or in any way relating to your use of this Website to binding arbitration conducted by a single arbitrator under the Commercial Rule of the American Arbitration Association (“AAA”) in Chicago, Illinois, rather than a proceeding in a court of law. The award of the arbitrator shall be final and binding on the parties hereto and may be enforced in any court of competent jurisdiction. The prevailing party in any action or proceeding to enforce its rights hereunder shall be entitled to recover reasonable attorneys’ fees and other reasonable costs, including fees of the arbitrator and the AAA, incurred in the action or proceeding. To the extent allowed by law, you and CashLendingNow each agree to waive any right to pursue disputes on a consolidated or class-wide basis; that is, to either join a claim with the claim of any other person or entity, or assert a claim in a representative capacity on behalf of anyone else in any lawsuit, arbitration, or other proceeding. You hereby understand that by agreeing to this class action waiver, you may only bring claims against CashLendingNow in an individual capacity and not as a plaintiff or class member in any purported class action or representative proceeding.

For any and all disputes you may have, whether pursued in court or arbitration, you must first provide CashLendingNow an opportunity to resolve the dispute by providing written notification to info@CashLendingNow.com and via postal mail to WEI MORE LOANS, LLC. 479 E Business Center Drive, Mount Prospect, IL 60056 stating (i) your full name, (ii) your address on file, (iii) a written description of your claim, and (iv) a description of the specific relief you seek. If CashLendingNow does not resolve the dispute within 30 days upon receiving your notification, you may pursue your dispute as set forth above.

If any provision of these Terms of Use is deemed to be unenforceable or invalid by any court or arbitrator of competent jurisdiction, these Terms of Use as a whole shall not be deemed unlawful, void or unenforceable, but only that particular provision(s) of these Terms of Use that is unlawful, void or unenforceable shall be limited or rejected from these Terms of Use. The remaining provisions of these Terms of Use will otherwise remain in full force and effect.

14. These Terms of Use are subject to change from time to time in our sole discretion to accommodate to new technologies, regulatory requirements, industry best practices, or for other purposes. If any of the changes to these Terms of Use are material we will provide notice to you or obtain your consent where required by applicable law.
